An expert witness report sets out an independent expert’s findings on the technical questions in a dispute: what the defects are, what caused them, whether the work complies with the NCC and the relevant Australian Standards, and what rectification will cost. Unlike an ordinary inspection report, it is prepared under an expert witness code of conduct, which means the engineer’s duty is to the tribunal.
That independence is the whole point. A report written to please a client gets pulled apart in cross-examination. A report that states what the evidence supports, including the parts that do not help the engaging party, is the one a tribunal relies on. Most of our expert witness engagements involve residential and strata defect claims in NSW, where timing is set by statute. Under the Home Building Act 1989 (NSW), the warranty period is six years from completion for a major defect, such as a failure of waterproofing, fire safety systems or a load-bearing element, and two years for other defects. Miss the window and the claim is gone, however strong the evidence.
